These Terms of Service ("Terms") govern your access to and use of the Automotive Dataset APIs, enterprise data feeds, and platforms.
Effective Date: January 1, 2026
By registering for an API key, executing a Master Services Agreement (MSA), or actively accessing our data endpoints, you ("Client", "You", or "Developer") agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our Services.
Subject to these Terms and the payment of applicable fees, Automotive Dataset grants you a limited, worldwide, non-exclusive, non-transferable, revocable license to access and use our APIs strictly for your internal business operations and customer-facing applications.
To access the API, you must register for an account. You are solely responsible for maintaining the confidentiality of your API keys and account credentials. You agree to notify us immediately of any unauthorized use of your keys. We are not liable for any loss or damage arising from your failure to protect your API keys. Usage generated under your keys will be billed to your account.
While Automotive Dataset aggregates from authoritative OEM, DMV, and National Highway Traffic Safety Administration (NHTSA) sources, automotive data is complex and subject to manufacturing anomalies.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". AUTOMOTIVE DATASET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE DATA WILL BE 100% ERROR-FREE, ACCURATE IN ALL CASES, OR UNINTERRUPTED.
Your API access is strictly subject to the usage limits and Rate Limits (RPM/RPS) defined by your selected subscription tier. Exceeding these limits will result in HTTP 429 Too Many Requests responses.
If you are on an enterprise billing plan with overage allowances, usage beyond your monthly quota will be billed automatically at the overage rate specified in your contract at the end of the billing cycle.
We aim to provide a 99.9% uptime for our core API endpoints. However, we do not guarantee continuous, uninterrupted access to the API. Scheduled maintenance windows will be communicated to active users via email at least 48 hours in advance. For Enterprise clients, specific SLA terms and uptime guarantees will be governed by your Master Services Agreement (MSA).
IN NO EVENT SHALL AUTOMOTIVE DATASET, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
You agree to defend, indemnify and hold harmless Automotive Dataset and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.
We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, including for violations of these Terms (e.g., scraping, payment failure). Upon termination, your API keys will be immediately revoked, and you must delete any cached data originating from our API unless specifically permitted by a continuing commercial agreement.
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Automotive Dataset operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
